Sony Centre and QANTAS "One Million Points Giveaway"

Terms and Conditions

  1. Information on how to enter and prizes form part of the terms and conditions of entry. Entry into the promotion or acceptance of a prize is deemed acceptance of these terms and conditions by each entrant or winner.

  2. The promoter is Sony Australia Limited (ABN 59 001 215 354) of 33-39 Talavera Rd, North Ryde, New South Wales (telephone number 02 9887 6666) (Promoter).

  3. The promotion commences at 6am (Sydney time) on 01 September 2008 and closes at 11.59pm (Sydney time) on 30 September 2008 (Promotion Period).

  4. Entry is only open to members of the Qantas Frequent Flyer program aged over 18 years who are residents of Australia excluding:
    • (a) officers, management, employees (and their immediate families) of the Promoter, its related bodies corporate, printers, suppliers, providers and agencies associated with this promotion; and
    • (b) members whose Qantas Frequent Flyer account is suspended, cancelled or otherwise terminated at any time during the Promotion Period or at the time of a prize draw. (Eligible Entrants).

  5. To enter, Eligible Entrants must, during the Promotion Period:
    • (a) purchase any Sony product from a participating Sony Centre store in Australia (excluding NT and ACT). For the purposes of this promotion, a purchase includes any retail purchase of a Sony product with any payment plan offered by a participating Sony Centre store; and
    • (b) provide their full name and Qantas Frequent Flyer number to retail staff at the relevant store at time of making that purchase.
      (both (a) and (b) collectively represent an ‘Eligible Purchase’).

  6. Eligible Entrants will earn two (2) Qantas Frequent Flyer points for every dollar they spend (including GST) on a Sony product from one of the above participating Sony Centre stores during the Promotion Period (provided they quote their full name and Qantas Frequent Flyer number at the time of purchase). Eligible Entrants will automatically receive one (1) entry into the draw for each Qantas Frequent Flyer point they earn through the Promoter on Eligible Purchases made under paragraph 5 and 6 during the Promotion Period (excluding points earned on credit or charge cards used to pay for the Eligible Purchase).

  7. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these terms and conditions, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.

  8. Each Eligible Entrant must retain and may be required to present proof of purchase in order to claim a prize. Entrants will be requested to provide to the Promoter proof of purchase for all entries made within 30 days of being asked to do so by the Promoter. If an entrant is unable to provide proof of purchase for all entries made in the above timeframe, then all the entries of that entrant will be ineligible and deemed invalid. Proof of purchase includes showing the original and providing a photocopy of the Sony Centre store receipt for each Sony product purchased.

  9. Entrants can only enter in their own name. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm each winners’ identity, age, residential address, Qantas Frequent Flyer membership number, eligibility to enter and claim a prize and any information submitted by the winners in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. All prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

  10. The Promoter is not responsible for any lost, late or misdirected entries.

  11. The draws will take place at 4pm (Brisbane time) on 7/10/2008 at Greeneagle Distribution and Fulfilment, Unit 10, 20 Ricketty Street Mascot NSW 2020.

  12. The results of the draws (and any unclaimed prize draws) are final and no correspondence will be entered into.

  13. There will be one (1) draw for each participating Sony Centre store. The first eligible entry randomly drawn from all eligible entries received by each participating Sony Centre store will each win 100,000 Qantas Frequent Flyer (Prize Points). There are 10 participating Sony Centre stores Australia wide and a total of 10 prizes will be awarded nationally. The number of participating Sony Centres stores in each State is as follows: NSW: 2; VIC: 2; QLD: 2; SA: 1; WA: 2; TAS: 1. The notional value of each prize is up to A$3,580.00, based on the awards that could be obtained by redeeming the Prize Points through the Qantas Frequent Flyer program (as more fully defined in the Terms and Conditions of the Qantas Frequent Flyer program as ‘Awards’) as at 1 July 2008. For example, 100,000 Qantas Frequent Flyer points could be redeemed for one return Economy Classic Award flight between Sydney and Los Angeles (subject to Award flight availability) excluding applicable surcharges, fees and taxes.

  14. Total maximum prize pool value in each State is up to: NSW: $7160.00; VIC: $7160.00; QLD: $7160.00; SA: $3580.00; WA: $7160.00; TAS: $3580.00.

  15. The prize value may vary depending on the applicable Award flight(s) and/or other Qantas Frequent Flyer Award(s) chosen by each winner when redeeming their Prize Points. The number of Classic Award (as defined in the terms and conditions of the Qantas Frequent Flyer program) flight seats available is limited and availability depends on the flight, date, season and destination and some flights may not have any Classic Award seats available.

  16. The Promoter does not accept any responsibility or liability for any variation in the value of the prizes or any inability to redeem the Prize Points.

  17. The winners will be notified by telephone and by mail within two days of the draw and their names and localities will be published in The Australian newspaper on 21/10/2008. All reasonable steps to notify winners of the results of the draws will be taken by the Promoter.

  18. The Promoter is not responsible for any problem or technical malfunction of any communications network or lines, servers or providers, computer equipment, software, technical problems or any combination thereof, or any other technical failures. The Promoter is not responsible for or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise. The Promoter is not responsible for failure of any entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof or otherwise.

  19. Prize Points will be allocated to each winner's account within 28 days of the prize draw.

  20. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use a prize as stated. Prizes are not exchangeable for other goods or services and cannot be redeemed as cash. Prize Points may only be transferred to another person in accordance with the terms and conditions of the Qantas Frequent Flyer program (or if otherwise agreed to by Qantas Airways Limited and the Promoter). If a prize cannot be used as stated, it will be forfeited. The winner and any travel companion(s) will not accrue Qantas Frequent Flyer points on travel taken using Prize Points. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.

  21. The prize does not include surcharges, fees and taxes payable in cash for any Award, travel insurance, passports, visas, spending money, meals, accommodation, transfers, taxes, ground transportation and any other costs of a personal nature not stated. Compliance with any health or other government requirements is the responsibility of the prize winner and any travel companion(s). Without limiting the above, entry into any country and satisfying any customs or related requirements is the full responsibility of the winner. Award travel is subject to the fare rules and the Conditions of Carriage of the relevant carrier. All Award travel is at the risk of the winner and any nominated travel companion of the winner. The Promoter and Qantas Airways Limited make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and trade.

  22. Neither the Promoter, Qantas Airways Limited, the related bodies corporate of either, the associated agencies of either, nor their respective officers, employees, contractors or agents will be liable for any loss, damage or personal injury or death (including but not limited to direct, indirect and consequential loss) suffered or sustained (including but not limited to that arising from any person's negligence)  in connection with this promotion, the promotion of this promotion or the use of any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum amount allowable by law).

  23. If for any reason the promotion is not capable of running as planned because of  (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion (subject to any written directions made under applicable State legislation) to cancel, terminate, modify or suspend the promotion.

  24. The Promoter reserves the right to conduct such further draws as are necessary on 8/1/2009 at the same time and location as the original draw in the event of an entrant being unable to satisfy these terms and conditions or forfeiting or not claiming the prize, subject to any written direction given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA) or other State legislation. The winner of any unclaimed prize draw will be notified by telephone and by mail and their name and locality will be published in The Australian newspaper on 15/1/2009.

  25. If any prize or element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions made under applicable State legislation.

  26. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.

  27. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

  28. Caution: any attempt to deliberately damage the promotional website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.

  29. Each winner consents to the Promoter using the winner's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome). Each winner agrees to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents, unless the winner otherwise notifies the Promoter at the time of accepting the prize.

  30. Entry details remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding the prizes. Each Eligible Entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation. Without limiting the foregoing, Eligible Entrants' personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy Statement. A copy of the Promoter’s Privacy Policy may be obtained by contacting the Promoter. All personal information will be stored at the office of the Promoter. Entrants can gain access to, update or correct any personal information by contacting the Promoter at the address above.
