Sony Account (Creators’ Cloud) Privacy Policy

This Privacy Policy sets out how Sony Corporation, of 7-1 Konan 1-chome, Minato-ku, Tokyo 108-0075, Japan (“Sony”, “we”, “our” or “us”) collects, uses, stores and otherwise processes the Collected Data (defined as below) in relation to your account of “Creators’ Cloud” (“Account”).
It also describes your data protection rights, including the right to object to some of the processing which Sony carries out. More information about your rights, and how to exercise them, is set out in Section 7 below.
For the purposes of applicable data protection laws and regulations where the concepts of "controller" and "processor" are defined, Sony is the "controller" of the Collected Data described in this Privacy Policy.
“Sony Group Companies” means Sony Group Corporation, which is the ultimate parent company of Sony and any legal entities controlled by Sony Group Corporation (the term “control” in this context means the direct or indirect ownership of at least fifty percent (50%) of the voting interest in such corporation or the power in fact to control the management decisions of such entity).

In order to use certain applications or services, you will need to create and sign into the Account. If you choose to create an Account, Sony will assign identifiers and collect the following personal data. We use cookies and/or tokens as necessary for us to provide you the Account service safely (collectively as “Collected Data”).
l Data you input
We collect following data you input when you create the Account:
- Email address;
- Date of birth;
- Address (Country/Region and/or City); and/or
- Language preferences.
l Data we collect automatically
We collect data about your usage of the website of the Account (access status, traffic, routing, etc.).
2.1 Contract
Sony processes Collected Data in order to perform its contract with you to:
- provide you with certain functions of Creators’ Cloud (if you use Creators’ Cloud);
- maintain and control your Account; and
- respond to your inquiry about your Account.
2.2 Legitimate interest
Sony also processes Collected Data in order to pursue its legitimate interests in:
- protecting Sony Group Companies and the Account holders; and
- undertaking mergers, acquisitions, reorganizations or disposals.
Sony may collect and/or analyze Collected Data in order to identify potential security threats and to protect Sony, Sony Group Companies and the Account holders.
2.3 Consent (only for residents in Australia, India, Hong Kong and Taiwan)
If you give us your consent, Sony will share Collected Data with your local Sony office in order to send you information and offers for products and services from your local Sony office.
You can unsubscribe from receiving email marketing from your local Sony office at any time using “unsubscribe” link in such email or you can refer to the privacy policy for your local Sony office.

2.4 As required by law
Sony also processes Collected Data where required to do so by applicable law, for example in response to requests by government or law enforcement authorities conducting an investigation.
Collected Data that is communicated to and stored by Sony will be made available to other Sony Group Companies and to third parties as follows:
l Sony Group Companies and third party contractors
If you contact your local Sony office in relation to queries on the Account or for repair or return requests of Sony products, we also may need to share Collected Data with your Sony office in connection with that your request.
Sony may use Sony Group Companies and third party service providers to process the Collected Data. An important example of a service provider we use is Amazon Web Services: they provide data back-up services to us, and they are located in the US. The service providers are engaged for the purposes of pursuing the activities outlined in this Privacy Policy on Sony’s behalf, acting as processors of Sony.
l Business transfer
In the event that we sell or transfer a portion or all of our business, Collected Data may be transferred by us to the purchasing or acquiring entity as part of the transaction. We will continue to ensure the confidentiality of the Collected Data before such transaction occurs, and after such transaction, we will delete the Collected Data as soon as reasonably practicable after such transaction.
l Compliance and enforcement
We will retain, use and/or disclose any of Collected Data as required or permitted by law, regulation or order, including to the police or other appropriate authorities, to investigate complaints made by or against you, or to protect or defend ourselves, or others, against illegal, criminal or harmful activities.
Collected Data will be processed, stored and transferred for the purposes outlined in this Privacy Policy to various countries outside your country of residence, including Japan and the US. Collected Data will be processed by staff operating outside your country of residence who work for us or for one of our service providers and may be seen by such staff in those countries.
We will continue to retain Collected Data for 6 months after you delete the Account (or for so long as is allowed by local law). Please note that we may be required to retain certain information by law. Where Sony no longer requires the Collected Data, it will be destroyed or de-identified in line with internal information security policies. When we say de-identified, we mean that we will remove information that could be used to identify you from the Collected Data.
Sony is committed to complying with all applicable laws and regulations regarding the collection, storage and use of personal data concerning children. If you are a parent or guardian and are concerned that your child has provided us with personal data without your consent, you should contact us as indicated in Section 9 below.
In some countries, you have certain rights with respect to the personal information Sony holds about you. These may include rights to request a copy of the personal data that we hold about you, and/or you may request that we correct, amend, delete the Information if it is inaccurate. In some countries, you may also ask us to provide some types of the Information to you in a structured, machine-readable format and ask us to share (port) such data with another controller. These rights may be limited, for example if fulfilling your request would reveal personal data about another person, or if you ask us to delete Information which we are required by law to keep or have compelling legitimate interests in keeping. If you would like to exercise any of these rights, please contact us as described in Section 9 below.
This Privacy Policy may be updated from time to time for any reason. We will notify or request your consent (whenever necessary under the applicable law) of any changes to this Privacy Policy through the Account.
